  • Land Use & Environmental, Transactional Real Estate

  • Through its provision of legal services, McCullough, Goldberger & Staudt, LLP has been a major participant in development activity in Westchester and the surrounding counties. Partners Frank S. McCullough, Jr., James Staudt, Linda B. Whitehead and Seth M. Mandelbaum acted as zoning and real estate counsel for a significant portion of the development throughout the area.

    The firm has been involved in both the land acquisition and financing and land use approval stages of many varied types of development projects throughout the region. Projects have included shopping centers, office buildings and office campuses, large and small residential subdivisions, mixed use projects, nursing homes and other types of senior housing, and golf courses, as well as individual use site plan approvals, special use permits and zoning variances. The firm has also represented a number of religious institutions where land use processes have threatened religious freedom.

    In addition to her active land use practice, Linda B. Whitehead heads the firm's transactional real estate practice. Transactions range from the purchase and sale of single family homes to commercial transactions with complex financing scenarios and both purchases and sales of properties which are the subject of the firm's land use practice. The firm also serves as counsel to a number of Cooperative Corporations, Condominium Associations and Homeowners Associations.

    In addition to traditional land use matters, Seth M. Mandelbaum represents several technology companies with respect to the acquisition and development of their infrastructure throughout the Hudson Valley and Connecticut, including telecommunications and alternative energy fueling facilities.

    Not-for-profit entities have been an important part of the firm's clientele as well. Not-for-profit clients have included The Hebrew Hospital Home, Inc., Young Men's Christian Association of Central and Northern Westchester, Inc., Pace University, The New York Hospital, and Osborn Retirement Community. Attorneys with the firm also sit on the Boards of several other community and similar not-for-profit entities.

    Frank S. McCullough, Jr. has been a guest lecturer on Land Use Law at the Pace University School of Law and served as a speaker and panelist at the ITE Metropolitan Section. James Staudt has been active on various Land Use Law committees and has guest lectured at the Harvard University Graduate School of Design. Linda B. Whitehead sits on the Board of Directors of the Westchester Municipal Planning Federation and Frank S. McCullough, Jr., James Staudt, Linda B. Whitehead and Seth M. Mandelbaum have participated as speakers and panelists, in many of its programs. Mr. Mandelbaum has also been a frequent lecturer on alternative energy and green building issues. Frank S. McCullough, Jr. and Linda B. Whitehead serve on the Advisory Board of First American Title Insurance Company, Hudson Valley Region.
